INALIENABLE REMUNERATION (AUDIOVISUAL ROYALTIES) FOR THE PUBLIC BROADCASTING OF AUDIOVISUAL WORK - PRESENTATION AT WARSAW UNIVERSITY

On 11 April 2018 at Warsaw University, Janusz Piotr Kolczyński gave a lecture on inalienable remuneration (audiovisual royalties) for public broadcasting of audiovisual work, during a doctoral seminar chaired by Professor Monika Czajkowska-Dąbrowska.

The lecturer concluded that audiovisual royalties are now a very popular and one of the key sources of income for some authors or performers. In Poland, such royalties are charged for their benefit by the relevant organizations for the collective management of copyrights or neighbouring rights (“CMOs”).

The lecturer pointed, among other things, that the CMOs are not allowed to collect royalties for all the rights holders in a given category, e.g. screenwriters, without entrusting the relevant rights to the CMOs for collective management.

Therefore, there is no such thing as a universal collective management by CMOs from Poland for the benefit of all the rights holders in a given category located on planet Earth, e.g. actors, screenwriters, etc., which is now a frequent, albeit - in the lecturer’s opinion - a flawed practice of the CMOs in Poland.

Apart from that, the presentation also included an outline of the right to audiovisual royalties and the problem of temporary applicability of the so-called old royalty rate tables adopted by the Copyright Committee at the turn of the centuries.
